I have filed a suit for specific performance .The other side has taken a defence that the contract is hit by undue influence, coercion, misrepresentation..etc. The defendant in an telephonic conversation has admitted the contract and has postponed the date of execution of the document. My client has recorded the same in the CD and now the same has to be tested with the voice expert before the court of law. I want to have the address of an voice expert in Tamil Nadu and who could depose before the court by giving evidence.

You have to file a petition before the trial court, for sending the CD to forensic lab. By the order of the court you have to produce the CD before the voice expert. You have to pay the cost.
That expert who had given the opinion will be called as witness.

Government Forensic lab for voice is in Hyderabad. The court shall send it there on your expenses.

Mr.Arun Kumar guided rightly. But telephonic conversation may not be benefitted in specific performance case.
The agreement must be written on proper value of stamp paper and in presence of wittnessess.

But had it been a contract, oral consent when established can be held valid.

I have a gut feeling that U are putting the cart before the horse. If the defendant has taken a defence that the contract is hit by undue influence, coercion, misrepresentation ..etc., it is for him to prove it & not for you to disprove it. Undertake your Mission CD only if it is absolutely required as otherwise U may be hacking on the branch on which U are sitting.
