The birth year of the sister is important and was there any partition before 1956 is important.

When did your grand parents die?
Whether the property was self-acquired property or ancestral property of your grand father?
Whether your aunt (who had since died) has any son / daughter? When did she die?
Querist : Anonymous (Querist) 29 November 2010
My grand mother died in 1999.and property of my grand father was self acquired by him.my aunt when she was died has 2 sons and 3 daughters.

You have indicated your grandmothers death year. What about your grandfather's death year.
When did your aut die?
Why cannot answer the queries asked at one time instead of giving half answers.

i don't know exactly when my grand father died. he died before my grand mother's death. and my aunt died in 2005.
R.Ramachandran (Expert) 29 November 2010
Since it is the self-acquired property of your grand father, and your grand father had died without leaving any WILL, his property on his death will go by way of inheritance to the following in equal share:
1. To his wife (i.e. your grand mother)
2. Three sons (i.e. your father and his two brothers)
3. Two Daughters (i.e. your two aunts - including the one who died in 2005)

After your grand mother's death, her share will go equally to the following:

1. Three sons (i.e. your father and his two brothers)
2. Two Daughters (i.e. your two aunts - including the one who died in 2005).

Since one of your aunt had died her entire share (i.e. one that she was entitled at the time of her father's death; and the other to which she was at the time of her mother's death)will go equally to your aunt's two sons, three daughters and her husband.

You can pay the market value of proportionate share of the house and get a sale deed executed.
