Public notice

Querist : Anonymous (Querist) 20 August 2011 This query is : Resolved
There are complaints of fraud against a company and its employees in local police station.

now the company owner issued a public notice in newspaper and claims that i am responsible for all dealings and urge people not to disturb companies employee.

I want to know what can happen with employees now.
As the complaints also contained their name
Will they also booked for fraud by police or not?
Devajyoti Barman (Expert) 20 August 2011
If the employees are also in complicity with the office bearers of the company in the alleged fraud then they should also be implicated tin the charges.

thanks

Public notice do not have any value in the above case???

Yes if their name reflect in the complaint then police can arrest and public notice has no such impact after lodging FIR.

Sorry, I may like to differ with the views of the experts, as above.

Since the company owner has already owned the responsibility the employees can be absolved of the charge, as they would have acted on the orders of their employer only, but not at their own, unless any specific personal interest of their own is proved to benfit themselves fraudulently.

Not being a Government organization where set rules are there to challenge decision of the superiors against delegations, an employee of a private organisation has to abide by the decision of his employer to maintain their master-servant relationship.

You can explain your position before the Police,so as to avoid future inclination.
Give all the evidences and proofs if any with you against the employers.
That will save your interest.
