Grandparents property

(Querist) 10 March 2012 This query is : Resolved
My Grandparents has two children, One is my Mother and other is my uncle(My mothers Brother). Long Back(10+) when my Grandfather died, grandmother and my uncle, made my mother to sign in some registered papers which she didn't go through properly. Now we came to know that the document stated, my mother doesn't have any right in the property which her dad and mother had. Can we do anything regarding this? And also my grandmother has also transferred all the property to my uncle. Can anything been done to cancel that registration?

Now, very limited scope at this point of time.

Yuor mother can claim her share by filing a suit, but proving that her consent was fraudulently taken is difficult at this point of time.

Your case does not hold good in law as your mother have already signed the papers. Any how after going through the documents can cull out any thing lying in your favour or not?
adv. rajeev ( rajoo ) (Expert) 10 March 2012
there is no case, because your mother has signed before the registrar.

This shall be unwise to comment anything finally unless you or either of us go through the documents of the property under question. It shall be good for you to collect entire documents from local Patwari, since the day of death of your maternal grandfather till to day so that it may be duly seen what document was got prepared by your maternal uncle from your mother and what can be done.

You may also show those documents to any civil side pratising local lawyer.
