Power of attorney

Sir,

My brother has moved to USA at a short notice and is unlikely to return in near future. He has a flat at Goregaon in Mumbai. He has sent a Power of Attorney in my favour to deal with the property for sale, lease, rent etc. The POA is Notarized at USA and I got it franked for Rs.500/- in Mumbai. My queries are:-

1. Will the SRO Goregaon register this POA in my brother's absence?

2. Is this POA required to be Notarized in Mumbai too?

3. Is this POA valid for me to put the flat on rent and execute L&L agreement, including registration?

4. What action me and brother should take if I need to sell the house on his behalf in his absence?

For registering the POA sent from abroad the procedure is that the same should be attested by Indian High Commissioner/Embassy high official of that country, the same should be sent to the concerned registrar by a sealed cover. It should contain the details of the property situated within the jurisdictional limit of that registrar.
Ans. 1) No, follow the procedure,
2)POA cannot be notarized in Mumbai,
3)If duly registered, yes,
4)follow the procedure as cited.
