Court judgement applicablity

(Querist) 10 August 2014 This query is : Resolved
Hi all,

Could you please help me to know the applicability of the court judgement in the below case.

There was a court case in 1967 between 4 Plaintiffs and 10 defendants, out of 10, one is Government of AP and 2nd one is my grand father freedom fighter Chitti Raju.

Munsif court and applet court(district court) dismissed the plaintiffs petition in 1970 saying that the government legally allocated the property under freedom fighter quota.

Can any other person(s) file again a petition in the court or in the Tahisildar office after 44 years of the judgement?

Village Sarpanch is trying to influence the government officers with the help of one of the state cabinet minister and putting pressure on the government officers and asking them to do something in favour to them.

We have submitted the court judgement true copy to the Tahsildar and requested to dismiss the petitioners petition and also asked to provide the protection to us.

As he is influenced by the politicians he is asking the certified copy of the judgement, I think he is well aware no one can certify the judgement by seeing the true copy(Not photo copy) of the judgement.

We told we can show you the true copy and can produce photo copy of the true copy, however just to overcome this judgement he is asking the certified copy of the judgement.

Thanks,
Krishna Raju

You are misunderstood qua the word 'certified copy'. It only means you have to get the copy of the said judgment from the copying branch of the court and such copy is provided certified. Tehsildar is bound to obey the judgment ibid.

Thanks for your response.

Actually we have a true copy of the judgement it is mentioned as (True copy) in the last page of the judgement and there is no court seal or judge signature on that.

As this is very old judgement copy (1970), paper is also slightly damaged, however all the content readable.

We have applied for the fresh copy, but not sure this is available or not and not sure when we can get.

Tahasildar is questioning the genunity of this document, even though government was a Defendant 1(District collector) in the said judgement.

Thanks,
Krishna Raju

Just try and you will get the judgment from the Court. 40 year is not a very long time.

as per evidence act a 30 year old document is presumed to be true but the true copy does not cover it.

Apply for a Certified copy and keep the evidence with you.
There are other defendants - some of them may be having certified copy. Try in that line.
If you are in the possession of the land, you acquire the title by adverse possession for such a long time. Meet the District Collector and apprise the situation.

Wait for the certified copy if already applied or apply for it.

Instead of posting the query here, just seriously try to obtain the certified copy from record room and comply with the direction of Tehsildar.

I too agree with the experts.
