Date of Deed is 22.3.10 but date of franking NJSP on 25.3

Pl send me judgments or citations that document is invalid, as date of franking on the deed put as later date of execution of the said deed (Partnership deed) It is excuted on 22.3.2010, Stamp duty is franking date is put as 25.3.2010. It is suspected that the execution of the said deed is fraudulently done.

1. yes, when franking is to be done the document can be typed but should not bear any signature or date.
2. This may be a technical default and if of not much consequences then the deed can be treated as genuine.

Date of Partnership is also typed as 22.3.2010 and also signed the said deed by executants on that date. Later got it franking with date 25.3.2010. In fact on 19.12.2009 four (4) individual persons paid the amounts under one MOU to one person. Now those persons are intend to claim the said amounts under fradulent partnership deed saying that the firm has paid those payments. Originally the said payments are paid from their individuals savings bank accounts of those persons. At that time of payment they are not the partners and there is no partnership firm at all...is it not fraud?? When the partnership firm is not constituted at the time of payment made by those individuals and those individuals are making falsely this deed and claiming the amounts thru this firm is certainly fraud...I request you please suggest me or refer me citations on the abvoe propositions....please

Execution of a deed can be done before paying the stamp duty too, there is no legal infirmity in it. Therefore the date of execution can be a prior date to that of the date of stamp duty franked on the NJS paper.

Mr. Kalaiselvan Sir, if your point is perhaps correct, can we execute the promissory note before payment of stamp duty of the said revenue stap????..pl think on those lines...
