Application under 156(3)

(Querist) 06 August 2010 This query is : Resolved
A got FIR registered through 156(3) against B,C and D u/s 420/120B etc. subsequently due to circumtances, A recorded his statement under 161 releiving B from accusations and also gave affidavit to B to assure him that his name is cleared. however investigation will go on against B and C. What will be the implications
S. Bharath (Expert) 06 August 2010
Once the FIR is registered and investigation is set in motion, it is not for A to control or regulate the investigation. The implication as far as B is concerned depends on what the other witnesses say u/s 161. Are you by chance looking for answers about remedies available to B?

I do agree with Bharath.

Yes but at the same time the police has got power to give final report against b on the basis of your affidavit. Otherwise if parties reach to a settlement then they could get the case quashed from the high court.

i agree with you all.

Evidences during investigations may be helpful for such accused as B !
