Partition suit issue

we have filed a partition suit for 1/5 share of the property. Now we realized that we can ask for 1/2 share of the property. How to approach to court, are they any possibilities for amending addition partition suit.

How to resolve partition suit issue.

Please guide me.

apply to the court for leave to amend plaint with regard to relief sought

File the amandment application in place of 1/5 written 1/2 but the nature of suit not be change.

The relevant provision of law is Order 6 Rule 17 of Civil Procedure Code read with Section 151 of Civil Procedure Code for this purpose.

You can amend your plaint by filing a petition Under Order 6 Rule 17 and Section 151 C.P.C.
