Iam a respondent in u/s 9 of H.M. Act . I have received certified copy of some documents from Deputy Commsssioner's office under RTI ACt 2005 which are in the records of CAW CELL.

My Query : I want to sumitt those documents as additional evidence on argument date. Will court exhibit those documents or not ?

By mere production court cont exhibit the doucments. For production you will have file an application and recall yourself to get mark that documents. Otherwise they have no value.

Yes, no document can be exhibited at the sweet will of a party. There is a stage and procedure for getting a document exhibited. If your case has reached the stage of argument then I do not think the court will allow you to exhibit that document. However, you can try by recalling the witness for the purpose of formal proof of that document.

Rule 1.2 of CPC order 13 provides for production of documents. You can produce documens at any stage but before settlement.Additional documents not enclosed along with written statement or plaint can be produced with the leave of court. Refer to Billa Vs.Billa(SC 1994)in which certified copy obtained from revenue autahorities later was allowed to be produced.
