can an employer charge sheet an employee for his proceeding to court ?

Capt Sukhdev Singh vs The great eastern shipping co,
the company has charg sheeted one of their employee i.e. a senior master for his proceeding to the hon'ble high Court against them for his victimisation and non-payment of wages. The Charge No. 12 in the Charge sheet reads asbelow:
" You have proceed to High court against the company and filed suit ag................... have defamed the company's name therefoe you are guilty".
what can be the consequencess of this contempt of the company?

Company has got no right, title or interest what so ever it may be to initiate any legal action against you if you have approached any of the court for your lawful right. There is not even iota of bad name for the company if its unpaid employee has to approach High Court for seeking his legal demand of wages. If company do this then it is further guilty and High Court again be approached against such company.

This army person is putting his personal problems in various versions blaming advocates and even most respected HC judge.
Does he have conviction to put the matter which he has posted on this forum before the HC Judge and advocates against whom he is complaining.

Mr.Makkad has rightly advised . However, I would like to add further that the applicant should move either a Civil Application in his pending matter in the High Court or a separate Petition challenging the show cause notice in question. The action of the employer is illegal and untenable as every citizen of this country has right to seek legal remedy in the court of law and for doing so, no misconduct can be charged againist him.

More ever this person is blaming every body else than him self.
He has sent me a PM and my reply is that should I mention the comments he is giving about HC and its Judge before the bench where his case in on.
