should i file section 125 crpc case

Guest (Querist) 25 November 2010 This query is : Resolved
Iam married, its 5 months of our marriage. My husband and my inlaws have deserted me, and iam staying with my parents now. On minor petty issues, quarrels they have blamed me lot of things and they don't want to keep any relation with me, I have tried so much to convince my husband but he doesn't take my calls and ignores me, reconcilation process and counselling have failed, and my husband & inlaws are not taking it seriously, and they are not making any effort to maintain this marriage, so in this situation can i file a maintenance case of section 125 crpc, for maintenance, as i want to continue with this marriage but my husband doesn't want to live with me, so if i file for maintenance will i get that ?? Basically i want to ask if a wife wants to stay with the husband, but husband doesn't want ,in such situation section 125 crpc works, is it allowed ???? in such situation is the wife entitled to get maintenance from husband ???? just explain me please.

You can file restitution of conjugal rights petition against your husband and you can also file a criminal miscelleneous case u/s 125 claiming maintenance.

Thankyou so much sir....i will file my case. i don't want to break this marriage but iam afraid as my inlaws are inflicting nasty alligations on me regarding my character, just for divorce. All those alligations are false. but don't know what to do.

File case under PWDV Act. You will get the remedy.
