Law degree

Querist : Anonymous (Querist) 13 January 2011 This query is : Resolved
Law degree is done after completing the Bachelor degree. So the law degree should be treated as Post graduate degree only. But, it is not treated so, why?
Uma parameswaran (Expert) 13 January 2011
All the professional degrees are considered as Bachelor degree.

If some body does B.A., and then B.Com., whether B.Com will become post graduation for that person?
Just because minimum qualification for LL.B has been prescribed as degree, that in itself would not ipso facto mean that LL.B. is a post graduation.

Logically explained by Mr R.R
Arvind Singh Chauhan (Expert) 13 January 2011
Respected members I have heard that Supreme court already decided this issue, on the same version as suggested by Ram Chandran Sir. Please if any body finds it please attach here.

As per the logic of Mr.R.R., if B.com is done after B.A., B.com., is not a post graduate. that is true. but BA is not the requisite qualification for doing B.Com. The required qualification is only +2.

For doing MA, a graduation is needed. So, MA is post graduation.

Ms.Uma all professional degrees are done after +2 only. Take BE and MBBS. So, naturally they are graduate level only.

But, for doing LLB, the graduation is needed, so, LLB is Post graduation.

Mr.Arvind if you can find that Decision of the SC please post it here.

This is a very complicated issue for the simple reason that no prescribed definition is available anywhere under University Regulations. In fact, there are many politicians who directly qualify to gain MA degree and then B.L. Degree without undergoing any graduation. The classic example being my illustrious batch-mate Mr.Jeppiar, who is one of the Top Educationists in the country heading leading group of professional institutions in Chennai. Then how could this be accepted? Experts to elaborate with case laws.

Dear Mr. Partha,
Madras High Court, Punjab & Haryana High Court and thereafter Supreme Court have held that to get into LL.B. one has to have a regular 3 year degree certificate. The LL.B. followed by direct M.A. Course is not recognised. Now such direct M.A. courses have been discontinued. Perhaps past cases may not be re-opened.

Then how this logic could be applied to students who gain admission to 5- Year B.L. course after completing Plus Two exams (Std XII)? Please share specific citations as many law students are affected due to a faulty decision taken by University of Madras though the issue posted in this thread is different.
R.Ramachandran (Expert) 13 January 2011
There is a separate recognised Integrated 5 year residential Law Course after +2. This coure is being offered by National Law Universities.
During the 5 years of residential course, the student would get B.A. + LL.B., or B.Sc.+LL.B, or B.Com.+LL.B (depending upon the University where one pursues the course).
The maximum age limit for admission to such integrated course is 21 years.
The admission is through CLAT (Central Law Admission Test) etc.
The Government is planning to introduce more and more Integrated Law Courses - after some time, the 3 year LL.B. course would become a thing of the past.

Mr Anonymous,

"But, for doing LLB, the graduation is needed, so, LLB is Post graduation.", however, the same course you are discussing can be entered into after your +2 (5 yrs) to get a law degree, so can you call it graduation in your own words "Ms.Uma all professional degrees are done after +2 only. Take BE and MBBS. So, naturally they are graduate level only.", both the syllabus for 3 years and 5 years are one and the same except in the first 2 years of the 5 yrs course it is devoted towards orientation.
