hi
what is legal implication of absense in court by husband in 498a case, when he has not received any summon from court.
How does court validate whether summon was delivered to husband, how can husband request this information to check false POD of summon is given by wife side

There is no PoD, you have to sign the summons, or the officer who came to serve summons would mention decline to recieve which would be deemed service.

how can i get details, how was officer, at what time he came to deliver summon. what address summon was sent to ?

it seems there was missue in the process, have you seens such tactic based on your experience

If the case is a criminal complaint then the summons are to be filled by your side and are required to be submitted to the concerned staff of concerned/trial court and accordingly it is sent to the accused person with one copy to accused and another as its receipt but if the case is state case then there is no need to submit summons and court itself have to send the notice as per address mentioned in the FIR/report under section 173 criminal procedure code.

you can see court file and go through the notice sent/received back and if any mistake is found, you can bring it in the knowledge of the court which may be rectified.
