Govt- employee dad- probs by my wife

Guest (Querist) 28 December 2011 This query is : Resolved
Me and my wife are living separately. My wife has applied for RCR. I am not willing to join her. I am not willing to appear to court also.
My lawyer said that she may apply for dowry case and suspend my dad who is a govt. employee.
Is t ? We havenot askd any dowry from her. Hows to proceed for it?
M.Sheik Mohammed Ali (Expert) 28 December 2011
if you are not ask dowry she only proved before the court. you made out cruelty allegation to her

If you do not reconciliation then appear in that case and make a counter claim of divorce in the same suit.
If your father is a govt servant ans remains in custody for more than 24 hours then he may be suspended. To avoid this you have to be vigilant about filing of the criminal; case and once that is done you have to obtain anticipatory bail and once that is done half the battle is won.

It is advisable to appear in the court and fight the case. If you do not appear, then ex-parte order will be passed against you and if the order of court is not followed, that may lead to further problems.
it is true that your wife may initiate criminal proceedings against you as informed by your lawyer.

They are well armed and well guarded by law to initiate several civil as well as criminal proceedings against you;you simply need to contest or to accept her RCR,no third option.

I diagree with Shiekh Mohd Ali. You have to prove that dowry was not demanded the moment she opens mouth the presumption operates agaist you. If you and your father are arrested then deemed suspension will be there if custody is above 48 hours (which in any case is likely). Even during trial your deptt may initiate paralell proceedings. Better follow what other experts are saying.

There is no such presumption Mr. Sudhir. Please ignore it and act on the considered advise of other experts.
