my friend,an only son(no sibling) got married(arrenged)five years back.soon after the marriage the wife started behaiving abnormal,like not talking for long time,being in her own world etc.when asked for the reasons she wo,nt give any reply.things reached beyond control and boys family filed for a divorce,but she puts a condition that they should give her their house the only property they have she is on the joint names of my friend and his mom.in spite of all this girl stays in the same house ............is occupying a room ......also he is paying her rs 50,000 everymonth as maintaince,although she is working woman,which she wants to increase to rs 1,00,000.boy has lost his father due to all this tension and mom went through angiography.could you please advice how to get rid of her.they are scared she can put falls aligation and ruin them.

Your friend should have to learn first..How to stand fearlessly at own legs.
Fear and appeasement is not the ultimate solution of any problem. He should immediately stop providing any amount of maintenance to his wife as she is already working and capable to earn much for her maintenance.
Second step of your friend should be to persue his case vigorously and effectively. Your friend shall have to arrange for a shared household as per DV Act provisions but he can also get it arranged at outside.
The mother of your friend can also seek a partition of house and can get her separate portion or your friend can gift it in favour of his mother and then his mother can get eviction.

When wife is working she is not entittle for the maintenance. Your frend has to take bold decisions.

WHY A PERSON SHOULD ASK YOU TO AVAIL FREE EXPERT ADVISE, WHEN HE PAYS Rs. 50,000/- 50K PER MONTH TO HIS WIFE.
He can avail best of Legal Advise paying fees, which he must be doing.
What other experts have to say??
Only personal problems should be asked, that directly affect you.
