In service matter, is it necessary to pay the stamp duty in gujarat

i have filled a civil suit against Private limited company for reinstatement with full backwages and continuity of service with all benifits for one of the Manager who is terminated without inquiry and also alleged about late coming, not follow the superior's order etc.
now the reply filled by the respondent company and raised the preliminary issue that there is necessary to pay the stamp fees and due to non payment of stamp fees mateer may be reject only on the said ground
so i am not sury that the stamp fees is applicable to the service matter or not and if that is applicable then on which ground that is calculated. so pls give me answer as early as possible
some of the detail is as under
Post Safety manager
Salary per month Rs. 48500/-
Place of service Gandhidham-Kutch in Gujarat
Lenth of service 3.5 years.

IT IS CALLED COURT FEES AND NOT STAMP FEES AND IS CALCULATED ADVOLERUM ON A TOTAL OF AMOUNT CLAIMED WHICH IS SUBJECT GUJRAT 'S COURT FEES LAW WHICH MAY BE LESSER THAN IN UP.
IF THERE IS BUNGLING ABOUT IT ,BETTER BUY A COURT FEES ACT FROM LAW BOOK SHOP AND YOU CAN CALCULATE FROM IT'S SCHEDULE ON YOUR OWN.
