Is it necessary to probate a will regd in a small town?

will has to be proved in court of law . if brother is sole beneficiary brother ought to apply for probate .

the sister has no share in property as per the will . suit will go on for ages depending upon pendency of court cases in your area

Check with your state.
In WB every town irrespective of its size needs Probate.
There is no time limit for applying probate and it could be applied for at any point of time.

You had better go for probate; in case of delay, the matter can be expedited by filing a civil revision petition with request for directions to the lower court to dispose the case with in the time limit prescribe for the valid reasons put forth by you.
