i had give rs 40000 to a man in cash against a self cheque now he isnot returning mymoney i had crossed the cheque and bounced in the bank now when i call him he tells me i dont have money and again u will call me i will launch a police complaint of mental harasment for money so what can i do can i file a case and get my money but i dont have any proof that i had given himthe smone since it was in cash

Do not waste time. Engage an advocate, send him a notice and then file a case for dishonouring of cheque.
You can file case for cheating as well.

Issue a legal notice to him to refund ur amount with interest and damages in 30 days
time failing which file civil and criminal cases against him in courts.

Issue him a legal notice demanding the amount, and on his failure to return the same, file a complaint under NI Act for cheque dishonour.

you will have to prove that cheque was issued in respect of debt due and paybale . do you have nay acknowledgement signed by your friend .
if cheque is dsihonoured fie criminal complaint under section 138 Ni . also file summary suit for recovery of money
