Regarding will

(Querist) 06 September 2012 This query is : Resolved 
whether a christian lady can make will in favor of her daughter who is converted to Hindu religion ? whether practicing of other religion (whither Christian or Hindu) restricts a lady from making Will or taking benefits out of that Will.

1. A Christian lady or anybody can make a will in favour of :


a) her own relatives (near or distant relatives)
b) Hospitals, Charity, Old age / Orphanage / Destitute homes and so on
c) Politicians, Lepers, Beggars and so on
d) To any person (minor or major) of ANY religion (christian, hindu, muslim and so on)


2. IF the will-maker, specifically puts a condition in the will, stating the willed-property will devolve to the will-beneficiary, "ONLY" IF THE WILL-BENEFICIARY CONVERTS BACK TO CHRISTANITY, then the will-beneficiary will have to convert back to christanity, to avail the beneficiary rights bequeated by the will-maker.


NOTE: IF there are no legal heirs / claimants and there is no will, then the property of a deceased person will, by legal default, devolve with the state govt.
