Ipc 498 a

Sir,
My ex-wife illegally file the case against me in Kottayam District Kerala section IPC 498A. she file the case in 2005 unfortunately case can't open, so they reopened again in 2009. case No. CC-978/2009. (Now are in bail) from the date myself and my parents accuse 1,2 and 3 every time going court but she not coming court in between only one time she came court with her parents, (she is working in Mumbai last 20 years) I legally divorced her in 2011,now days ( last 5 hearing nobody is coming to court for attending the same) in between court call one witness but they told in court in my favour (out of three witness) third one is his Father.nowdays my Mother is bed patient 70 yrs old, father 80 years old he also can't walk properly I am working in Qatar, they are totally disturbing me. how we escape from this case, again case date is postponed next date 28/2/2013, because of her absence. I married her in 1992 and separated 2003 ( We have two son 20 and 14 years age) and illegally I married a widow in 2004 I have one son in wedding. actually their aim is I came in India as a jobless man.

you are lucky she has not filed case for bigamy aginst you . how can you remarry when your marriage was subsisting .

as fr as your parents are concerned make application for exemption from personal appearance until further orders . the fact that your aprets are old and infirm AND BED RIDDEN WILL HELP YOU .

Your parents need not attend court u/s 205, of Cr. p.c. and even you can apply and get exemption to appear.

You ask your Advocate to apply accordingly. It will be allowed.
