Home loan on unregistered agreement

(Querist) 29 December 2012 This query is : Resolved 
I want to purchase one flat in registered society, but before giving token i referred the documents. I Noticed that there is no registration & payment of stamp duty is not proper for Previous 2 agreements which is made in 1986 & 1992. Let me know there is any legal problem for purchasing this flat if my seller pays only stamp duty for both agreements without registration. since as per enquiry we got the response there is not possible to registration of old agreements if other parties of agreement is not treceable.
If there is no legal problem then can bank will sanctionedHome Loan on that paper..


Please guide me or suggest any alternative for registration of old agreements without second party...

Since previous documents were not properly stamped, it is not advisable to purchase the property unless the previous sellers and buyers are added as party to your sale deed.

it is not necessary to register agreement for purchase of flat on resale basis in a cooperative society . however problem is that no bank will give you loan if earlier agreements not regd . bank wants title clear and marketable .

If original owner is ready to execute fresh agreement in your favour, htere is no problem for either bank or you to do the needful.

where he claims that he is practising from 2001, while as already indicated by me, he was enrolled only in the year 2012!!! CAN ANYBODY PRACTICE BEFORE ENROLMENT? IF ONE DOES SUCH A PRACTICE IS HE NOT FIT TO BE CALLED A "FRAUD"?
