Protection of women from domestic violence act, 2005

(Querist) 04 January 2013 This query is : Resolved
Sir,
I am for the Respondent in the matter U/s. 12 of Protection of Women from Domestic Violence Act, 2005.
What are the stages under the said Act. Do I have to make an application for Bail on the first date of hearing?
Can I file my Written Statement?
Thanking you in anticipation.
Raj Kumar Makkad (Expert) 04 January 2013
This is not a criminal case hence you do not require to move any application for bail. This case is like 125 Cr. PC petition. You should file written statement/reply of the application on affidavit supported with your affidavit.

Some courts do provide opportunity to lead oral evidence whereas other only require affidavits with documentary evidence so do according to the process being adopted by court,

Well advised by Mr. Makkad.

I will be adding one thing that the DV Act itself is self exhaustive. Read Chapter IV carefully, it provides the entire procedure.

NJS Sir! I do welcome appreciation but current queries are waiting for our opinion. It is very easy to touch an old resolved query rather of replying the current one.
