Loss in business

Dear Sir or Dear Madam ,

This is ketan working as a Sales person . This is a case where my father is a victim .

# Father is doing a business in Diamond ( Re-selling )
# At a point his client ( to whom the diamond had been sold ) refuse to give payment
# Now the collector ( from whom diamond purchase ) is asking for payment as it goes over due of around 60 days

Now the Collector is asking for payment in any way if the payment will not comes from client and force us to sell-off our home .

# The Home is on the name of My father and on 15 year Bank loan of 15 lacs .

I do not want to do this things . Shall I fight agaisnt them to save this home ? or we have to sold this home and pay to the collector .

Please advice . . . .

You may need to file cases for counter measures to save your father.

your father ought to file case against the buyer . you msut have proof of sale of diamond , invoice , delivery challan . contact a local lawyer

The seller is right to recover his outstanding dues and your father is legally bound to make his debts cleared but what is about the buyer. Has your father initiated any action against him? if not, he should do so.

Your house cannot be sold by you as the same is already mortgaged with banker and the mortgaged property cannot be sold until the same is redeemed back.

Your case need be examined in detail with reference to case related documents, proof of sales/ Bills, delivery proof of diamend to either party, home loan details, mortgage deed for home with bank and how the property is linked with the diamond, etc.
