Tender conditions

My Question is simple. In our tender conditions, two conditions are contrary. Now the tender has been opened. Can we modify the conditions? or delete one of the conditions Now?

If it is open tender and want to modify/ delete any condition, you will have to cancel the existing tender by notifying through the newspapers through which you earlier notified to call for the tenders, and issue fresh tender notification separately by due notification as per the prescribed tendering process. That is necessary as some others may also be interested to submit their tender on account of removal/ modification of contradictory terms.

However, if the tender was a limited tender, you can give the option to the existing tenderers either to accept the modified terms or withdraw their tenders, if liked by any of them. This process may avoid raising of any dispute by the tenderers at some later stage.

The conditions cannot be changed after opening of the tender rather it has to be cancelled and fresh tenders are required to be invited.
