Anticipatory bail in 498a pending

(Querist) 07 February 2013 This query is : Resolved

Dear Freinds,

The case is relevant to extortion of money from wife side due to that filed 498a implicating all members of husbnad family. session judge is calling the husbnad but husbnad denied through learned advocate that he does not want to talk anythings with such wife who implicated in false case till the time of declaring innocent.
sir my queries that :-

The h'rble session judge can give bail to husbnad as the husbnad backgroung is truely very honest and session judge also thought that wife has implicated for balckmailing by filing the case and retainig the two children to the husbnad to extort money for giving support to her parent. the bail is lying pending in last eight month. the charge sheet is also not submitted but dairy submitted which is totaly in favour of husband as the some main points of private fIR are declared wrong by police.

sir, kindly advice what to do by the husbnad as the judge is calling for compromise but husbnad can not compromise with such wife but agree to maitain 100% expences of children . main things are that wife has implicated not only husbnad but also the senior citizen of family who are not lived with her any time during the 12 years of marrige life.

always advisable to compromise . settle for divorce by mutual consent .

Compromise do not contain only restitution of conjugal rights rather it also includes mutual divorce. If life cannot be run ith such lady, better to explore the possibility of mutual divorce with understanding.
