Whether i am owner ?

(Querist) 13 March 2013 This query is : Resolved 
(it is a related question to my previous question)

I had purchased a MCD Leasehold Property in 1969 from Original Lessee.

A Sale Deed was registered by Sub-Registar.


Query :

1. What is my Legal Status ?

2. Whether I have become absolute owner ?

3. Whether I can execute a Registered Sale Deed to sell this property ?

Your Transferor is only Lessee of MCD! what are the rights of the Your Transferor from MCD, that much only can be trnasferable to You . It is the MCD Lease Hold Property , the sale is madeby lessee . You have to get the Sale confirmation by MCD confirming the sale made by your transferor to you , as per the Scheme of MCD , Lease Properties are converted in to sales infavour of Lesees, those Scheme benefits can be availed by you!

The original lease deed need to be seen.
If there was no restriction on sub lease you have received what the lessee had in his original lease deed but for the duration of lease hold interest of lessee only.
