This query is : Resolved
some banking PSUs have a workmen employee director i.e a worker appointed by govt of INDIA to the board. under what provisions did they do that. I went through some websites related to that which mentioned that in 1971 GOVT of INDIA had formulated some policy making it mandatory for all PSUs to appoint a Worker Director in their Board and also a supreme court judgement related to this was announcaed in 1989. kindly appraise me on this subject

Although it is an acedemic query yet an interesting point "Worker director" appointed by govt, which is contradictory in itself as defined in Industrial Disputes Act.

Respected Legal Luminaries,With Due respect to your profession,I submit the following. After serving HAL trade union as Executive committee member(twice), I am now the General Secretary of HAL SC/ST Assn,Bangalore. I had posted a query regarding " Appointment of a Workmen by the Govt of India as a WORKMEN EMPLOYEE DIRECTOR in the Board of all PSU Banks". with my little knowledge,I was able to collect the below information. In 1971 Govt of India made it mandatory for all PSUs to have a workmen Employee Director on the Board. For the banks, statutory amendments in 1973 to the State Bank of India Act 1959 and the Banking Regulation Act 1969 provided for the appointment of one workman (nonexecutive)Director and one non-workman (officer/executive) director in each bank. Sir/Madam,I want to know the rules/guidelines which was formulated in 1971 by Govt of India. I am seeking this Information, since many profit making PSUs in India are closed or on the verge of closing inspite of having hardworking/Dedicated Employees & Officers is due to mismanagement,Wrong Decisions, Immproper planning, corruption.unilateral Decisions, careless & carefree attitude without any dedication/Involvement towards the organisation by the top management. This is the same scenario prevailing in Hindustan Aeronautics Limited & many other PSUs. The only way by which The PSUs can be saved is by Appointment of Workmen/officer Employee Director on the Board.Hence the valuable guidance/inputs of all the legal luminaries is needed on the above to save PSUs. Regards,Bala.
