Probate on will -advice with comments

(Querist) 09 August 2013 This query is : Resolved 
Dear Sir,
a persons father (Hindu) expired leaving behind him "Registered Will" all the legal heirs are confirming the will and not disputing the same in that context i have following queries:-

* Whether "Will" is required to be compulsorily probated" even if all the legal heirs are consenting and not disputing the Will ?

* If probate is not required then "what documents need to be prepared" to submit the said unprobated will with society/other statutory authority ? i.e. settlement deed of will by all the legal heirs ?

Please comment and if possible mail me one specimen document alike " Confirmation Deed of the Will by all legal Heirs" or similar document

if there is no dispute among legal heirs you need not take probate .
application can be made to society for transfer of flat in name of legal heir . obtain NOC from other legal heirs . indemnity bond will have to be furnished in favour of society .
