hi, i have been married from last 2 and a half year,i have one daughter of 1 yr. this was the second marriage of my husband but my first. as i was financially poor and my father was bed ridden, i said yes for the marriage. but from last 3-4 months, he is mentally torturing me a lot and abuses me. He doesn't love me and our daughter. i want a divorce and maintainence for me and my child.

You are entitled for maintenance, if not working, however, your husband shall have to pay maintenance for your daughter.
Try, negotiate, compromise and reconcile to save the matrimonial institution.

If you want divorce then you have file suit for this and claim alimony.
However I would suggest to give it one last try before going for divorce.
Divorce is not the only solution for your problem.

contact a local lawyer . as advised by experts you can file Dv case ask for maintenance and protection order against your husband . in the alternative file for divorce and claim maintenance

You can take the help of Protection Officer who shall issue notice to your husband and shall try to find out amicable settlement and if no such settlement is arrived then the petition under DVC shall be filed on your behalf by them.
