Redemption of mortage

A person has availed loan of 30L P.L, pledged his property as security for the said 30L, now says tat the financial institution has disbursed only 15L, but he has pais EMI for 10 months and have then defaulted, he has filed suit for redemption under these ground as if only 15L money was given and has just deposited 2L with the court and has got an order of injunction against the auction, pls suggest how to contest the case any citations for vacating the interim order

What is ur locus standi in the matter? Are u the lender? However, it may be clarified that the Injunction is an interim relief granted to the borrower. The lender may consider applying to the court for vacation of the injunction order on the ground that a huge amount of the loan is outstanding and that the plaintiff defaulted in payment of the same.

You may file a petition to vacate the injunction order on the basis of the facts available on your side along with the calculation memo of the transactions till date.
