Can my complainant be closed if case is pending

Dear Sir,

I expect an advice regarding

i got B report from police in 420 case lodged against me by a false complaint ( twice , 1st by local police and then by Supt. of police )the matter is pendind in JMFC court, since the complainant is absent for consecutive 7 hearings.

I approached the consumer court due to two years deadlines. here also they have taken two times date to file written statement.

File Section 482 Cr.P.C proceeding in the State Higj Court or a Criminal Writ of Mandamus before the State High Court for a direction to the courts below for speedier disposal of these false cases against you with all your proofs of your innocence and also quashing of these false proceedings against you including the relief of hefty compensation from the opposite parties/mainly those who filed false cases against you on account of this physical and mental harassment etc being caused to you by them on account of their false cases.

Dear Madam,

Thankx fr yr advice, Since i hav already engaged a lawyer, who on behalf of me has filed a complaint at District Consumer forum, Bellary ( Kar.) while a case as mentioned is pending at Taluk: hospet court ( JMFC) Dist: bellary ( Kar.)for consecutive seven times since april 2012 till date complainant is absent and there lawyer is taking time. A.P.P is also not present for 03 times.

i want to know will i get releif from Distt Consumer Court. as i came to know that in consumer court if any pending cases are there they are rejected. then how i can persue my case.

It s really weird as to how consumer forum allows 2 years time for written reply.
Consult another advocate.
You can apply for discharge in the trial court if your case has such merit.

Sec.420 I.P.C is a cognizable,non-bailable offense but compoundable before the court it may continue years after years so it is advisable to follow inhume the proceeding by filing an application in the High Court to quash the proceeding, of course, if you have sufficient evidence to prove your innocence.
