Hi!I wanted sum legal advice.
My mom runs a mill in village of south, since 12yrs.Since v live in Mumbai,as a caretaker v kept my dad's cousin(who lost evrythng, ws in road whn v helped, nw married his 2 daughters & thru sum his personal court cases he gt 80 Lakhs worth property, wh also ws registered wid my moms account).
V gv signing authority of cheque 2 him & also 10% share of mill income. Last year v hd a fight, since den he s nt
gving any account details, nt gving our cheque & still living wid family in our mill & found other party & running
other mill,using our stock & mill as a godown..V still dint tk any step cause my parents are seeing an alliance 4 me
& reffering address is our mill..if v fight..he might say al wrng thngs abt me..Nw he s spreading news, " our mill
hs 50Lakhs depth,so he closed it & running other..in near future he might evn buy our mill." But till nw he hv nt
shwed anyone & no one hs cum forward _ regarding dept. Nw al of sudden he claims he hv gvn blank cheques 2 a dealer for worth 23Lakhs & he doesnt gv his number or anythng 2 clarify wid him.
He dint gv account detail since Nov 2012,bt wid little fight he submitted accounts to our auditor 4 IT,evn our
Auditor is wid him, also Bank manager..Since he keeps giving dem gifts.v still dint gt a copy. Our relatives r wid
us bt dat s nt going 2 help..my dad wont tk any step till my mariage..bt i wnt 2 knw step 2 b taken 2 save our
property & also cheque..WHT MEASURES CN B TAKEN WITHOUT HIS KNOWLEDGE & LATER V CN ATTACK HIM WID ASSURANCE..
specially cheque-cn v do a police complain saying, patner s nt gving account details & v doubt his loyalty,so any
cheque bounce from 2dys date would be nt responsible by us..IS IT POSSIBLE??

issue legal notice to caretaker asking him to furnish audited accounts for last 3 years. the vent he fails to do so issue him eviction notice to vacate the premises .

Withdraw operating mandate of Bank Accounts from him and ask Bank to stop payment of all remaining cheques. Open new account and operate from it. Take help of local Lawyer. Send notice for vacating the premises and production of account. Immediately appoint some experienced Manager to look into the matter of the mill.
