Consult local lawyer. The employer can not keep the passport and original Id.

Why don't your friend come forward to give clear picture of his problem, as from your description it seems as if you are telling some hypothetic and fabricated story stating a person not only taking different types of drugs but also a seller of all types of durgs. Your story becomes unbelievable further when I find an accountant (yourself) is having a friendship with a security guard who is drug addict also.

Mr. Nilesh,
Your description, in itself makes your story doubtful, as in one query you have asked for punishment for the offences, somewhere you have said taking drugs and somewhere said selling drugs. Any person having some problem, don't ask for quantum of punishment, rather seeks solution to the problem, which you did not do.
Further, unless you discuss the contents of FIR, what is the report of the inquiry officer, and under what section your friend is booked by police, no appropriate opinion can be formed. Still further, it is not under which section to defend, but it should be the sections under which booked and to defend against such sections under which your friend is booked by the police and with what charge. Still further, defence is not made under sections, but on merits and truthfullness of the case.

A good observation and suggestion by expert Mr. Dhingra on the author's hypothetical query. Some people are in the habit of passing their time by posting such blatant and absurd questions having contradictions from the beginning till the end. The author may consult a local lawyer for solving the issues after this.
