(Querist) 13 October 2014 This query is : Resolved 
I had filed a police complaint against a person who had defrauded me. Due to lack of documentary evidence police did not investigate my matter.
Same person had defrauded another individual in another cheating case for which complaint was filed against him in same police station. I had filed an RTI to police dept seeking information on the action taken against the fraudster basis other complaint.
In a reply recd against RTI police have said that they have filed (closed) the case without assigning any reason though telephonically the IO told me that complainant did not come to PS on several calls.
Can I file an appeal against RTI reply as to why no action was taken since the person involved was a habitual fraudster & cheater.
Is there any way Police be asked to investigate and file FIR basis other complaint.

In RTI you can ask material information which has been provided to you.

The reasons for particular action/inaction are not admissible.

you can file complaint with the magistrate.

As they have provided the information sought by you, you have no further remedy under RTI Act. It does provide only information nothing more than that.

As regards police inaction, the complainant can take up the matter with the next higher authority of Police Department.

If you are aggrieved over the inaction by the police on your complaint, you may prefer a private complaint before the jurisdictional magistrate under section 156(3) of criminal procedure code, 1973 seeking direction to police to re-investigate the case and render you justice. Consult your lawyer and proceed.
