Harrasment

Respected sir,
A person who bought a share of one of the co-owner in the property is threatening us and harassing so that we surrender our share in property.
Few days back he send some people to us to threat us and restraining us to file a suit in the court for partition. They attacked on me but luckily I escaped. Then I lodged a complaint in the police station but taken back the complaint later after he told us that it will not happen again. After few days he filed false SC/ST complaint against us through 3rd person and told us that he will take back complaint later. He said he did this as a safety towards complaint filed by us. Be he didn’t took back complaint and using this false complaint to acquire property by blackmailing us. He may try to put more false cases against us or try to hurt me or my family physically in future.
What steps should I take in these circumstances? I do not want to lodge a police complaint before he takes some illegal step.

pls approach the appropriate court (whichever state you are living) immediately for injunction order.

You can directly approach the police commissioner office and explain your predicament, one of them atleast would surely help you out.

If case is registered against you under SC/ST act proceed to take bail. Consult a local lawyer.

File case of partition. Your lawyer would take care / advise on your legal interest.

Thank you Mr. goyal. The thing is that he had given formal complaint in commisioner office and FIR is not registered yet as he is interested just in property and not in lodging cases. He is using complaint to threat us.

Donot budge to the pressures of any kind. As advised, it will be better you move an application to take an anticipatory bail in the complaint registered against you though there is no FIR, it will send strong signals to him that you are ready to face his challenge legally for all his illegal claims in the property, if it is so. Consult your lawyer for further steps in this regard.
