hello sir,
we lend 10 lac rupees by cheque to a family friend before 4 years ago. now he do not pay back the money. we do not have any written agreement.
we have only cheque photo copy as a evidence.
any legal advice how can we recover our money

No civil suit lies now. You can only file case of cheating now.

3 years is the limitation which is already expired. No remedy for recovery through civil court. You have to test your luck by filing cheating case.

Apparently recovery of money is time barred but by following legal tricks you can go across the barrier but such tricks is bit costly.

Though time barred, you can serve a notice demanding the money back, preferably through an advocate.

The claim is time barred, if no written acknowledgement of debt available extending limitation.

As suggested by one expert, you may send a legal demand notice based on the evidence of having lent the loan by way of cheque and demand the repayment of the same, if he acknowledges the loan amount, you may create a limitation afresh. I requires bit legal ricks as suggested by learned senior counsel respected Mr. Roy sir.

Advocates demand notice at the outset will spoil the case whereas, a strategic letter drafted by a lawyer which will send by the lender shall definitely be effective. In the year 1975 I recovered money on behalf of Late Mr. K. Chaturvedi, Advocate a famous and well known practitioner of Income Tax Bar at Kolkata and India famous author of INCOME TAX ACT.
