In a Motor Accident case, the FIR is lodged and court has issued two notices. The opponent doesn't appear n the vehicle not insured. On personal contact, they say police wrongly involved their vehicle. Can any expert guide?

There r numerous cases in which the offending vehicles are not insured. In many of my cases, the vehicles belonged to farmers. They leave in their farms. They don't hurt advocates nor care to appear in court. When we get attachment decree they declare the property as a means of earning. Or show inability to pay compensation. Recently Hon. SC has passed the verdict that when the opponent is not capable to pay the State should pay. Can anyone throw further light on this
