Dv act and my cross

(Querist) 21 July 2015 This query is : Resolved 
Respected Sir/Madam,

In DV case, my Cross is going to start in next week . Other party evidence is closed. I had to resign from my job as other party had approached to my employer for salary details. Recently I managed to get better Job. Can I deny to tell new job company and salary in my cross ? Or any advise what should I tell ?? Thanks in advance.

Left of job can not waive the maintenance allowance, by suppressing facts may lead to a penalty when your wife will produce proof about your new employment. So,go by clean hand, rather you can furnish your liabilities to your parent and other expenses.

Who has adviced U to resign UR job to evade paying maintenance to UR wife? Even if U R unemployed the court will direct U to pay maintenance to her.

Moreover, you will, in all probability, be exposed if you lie under oath.

You should not suppress the facts before court during cross examination.

You will attract adverse inference if you try to suppress the employment details and salary particulars, hence it is advisable to proceed on the advice of your own lawyer who can guide you based on the circumstances.

In cross examination, you cam highlight the action of your wife to approach your employer, that resulted your unemployment.

She may do it again too. So your job is temporary.
other important facts are not disclosed like: wife's salary, your parents health and liability ? Any child ? Your residence etc..

Most probably she is unaware of your new job, and you can say, you lost that job..
