Loan on will

(Querist) 11 October 2015 This query is : Resolved
sir ,my father has a registered will of my grandfather,is he able to get the loan on the property given to my father on that will
Sudhir Kumar, Advocate (Expert) 12 October 2015
Will is not a title document. It can anytime be changed by your grandfather. even regd will can be changed bu unregd one.

I do not think that any bank official will be keen on losing job by accepting a WILL as a security.

You can ask bank.
Sudhir Kumar, Advocate (Expert) 12 October 2015
Further every will is meant to be challenged. There is no guarantee that your father may get any property from the WILL.
nitin jain (Querist) 12 October 2015
my grandfather has expired so in that case it is valid or not
alexander (Expert) 12 October 2015
Ld Colleague Sudhir Kumarji has advised you well. A WILL only comes in to effect / becomes executable only after the demise of the Testator ( the person who made the WILL)
Anirudh (Expert) 12 October 2015
IF your grand father has expired and on the basis of the WILL your father is to get the property, then first have the property mutated in your father's name on the basis of the WILL and then your father will be in a position to obtain the loan, showing the property in his name. Otherwise not.
Rajendra K Goyal (Expert) 12 October 2015
The property has to be mutated in the name of your father first on the basis of will.
K.S.Srinivas (Expert) 13 October 2015
Agreed with Sri Anirudh.
nitin jain (Querist) 14 October 2015
