Insurance claim

(Querist) 12 January 2010 This query is : Resolved 
Respected sir,
"X" & "Y" both are females was travelled on moped both having LLR License only from Transport Authority, and also having Insurance to the crime vehicle "Z" came suddenly confused the X & Y due to confused dashes Z. Z have serious injury both legs fractured, my query is 1. Is "Z" get insurance claim from the insurance company, X & Y both have LLR License only. 2. how much compensation should be passed by the court.

If any case please give me, i am waiting for your valuable suggestions.

1. Owner is liable in the given facts as insurance company shall be exenorated from its liability.

2. There are various facts which a court has to take into its consideration while deciding the quantum of compensation like income of the claimant/deceased, expenses incurred on treatment, his hospitalization, percentage of diaability etc. so no concrete reply to your quarry can be given without having all such facts.

Thank you Raj kumar ji, here "X" is the owner of the vehicle that too she has also LLR License from the Transport Authority, but she is very poor person, hence i am requesting sir, my query is (1) how to escape from liability. (2) i want to put liability on insurance company kindly suggest sir, i am waiting for valuable suggestions
