Hello sir, My name is shabrish kumar. My father is an govt employee worked in the library. He is a Librarian. On Dec 2010 my father was passed way, so I immediately applied for his job under compassionate ground on that day my age was 15 I'm studying 10th. I don't know the rules of the govt. After completing age 18 only can eligible to apply for job, I didn't know that, officers of library also didn't interpret me these rules, they accept my application. How can they accept my application?. At age of 18 again I applied for his job. Officers again accepted my application. After I finishing my degree (2016) I wrote petition to cmcell that I applied for my father's job on 2011 now I completed degree on 2016 still now I didn't get the job, pls take some action as soon as possible becoz my family is in financial problem, this is my petition. After the petition officers of library informing me that u had applied for job on at the age of 15 so we are not providing job to u, your application is rejected. I told them, I applied again 2 application at the age of 18 nd 21. They said these 2 application also rejected. I didn't know the reason. I said ok sir why you are not informed on that day when I applied for his job?? nd why you are accept my application??, you can reject my application immediately on that day but why you are not??why you are informing all those things after 6 yrs later nd after I wrote petition to cm?? It's not my fault.... So I want to know reason nd can I get my father's job??

If any Government Employee expires while in service, any legal dependent may apply for job on compassionate grounds subject to condition that, the applicant even a minor shall submitted application within a year from the date of death of the employee and the job will be given within two years from the date of death of the employee if the applicant attains majority during that time. otherwise other legal dependant may apply. Your application is rejected as you did not submit application after attaining the majority.

As per your queries, you might have not attained majority within two years from the date of death of your father.

Consult Lawyer who will be able to guide you. You can file writ petition seeking intereference in the matter.

Use RTI to get the information regarding reason for cancellation of the application of your application.
Discuss in detail with lawyer expert in service matters.

Compassionate appointment is not an open ended job to be applied any time after years together.
You may or may not get information through RTI, or may consult any lawyer, but there is a remote possibility of your getting job after 7 years. If any such vague advice is adhered, you may be wasting your own time, energy and money with end result as failure.

Dear NJS Rajkumar,
Senior officials are not delegated with any discretionary power, as against the Government prescribed rules on the issue of compassionate appointments. If the applicant is not eligible nobody can help him get appointment.

Dear NJS Rajkumar,
Don't go by the literary term, "compassionate." You may feel free to help the querist by offering your services, if you believe that appointment on compassionate grounds is merely a discretionary matter for the departmental authorities. You will be able to experience personally, what is what of the rules on the issue. Even courts may not help, even if a single condition, out of the several ones, is not fulfilled by the applicant.

There is a laid down policy of compassionate appointment. Prima-facie it is violation of Article 14&16. It is violation of Supreme Court norms restriction any type of reservation upto 50%. SO far none has challenged it.
This person was 15 year at the time of his father's death and certainly his mother was not minor and she did not apply.
His case is hopelessly time barred and matter is not worth even wasting Rs 10 + postage and stationary and time on RTI.

Hope, from the clear information provided by Mr. Dhingra and Mr. Sudhir Kumar of the facts, Mr. N.J.S. Rajkumar and the querist, Mr. Shabrish would have been satisfied about the compassionate appointments.
No one in Government or PSUs has the authority to make any compassionate appointment, even if a single one of the prescribed conditions is not fulfilled by any applicant. In case anyone attempts to do, he may not only be inviting disciplinary action by the department or the criminal proceedings under PC Act by the CBI against himself. Besides, the candidate can also be made liable for termination/ dismissal from service, if got appointment by way of favouritism by any authority.
