Filling a Petition in court on loss of Original Sale Deed

Querist : Anonymous (Querist) 14 July 2010 This query is : Resolved
Hi Experts,

As advised by the experts here I have given the paper advertisement in the local news paper along with the police complaint on loss my of original land sale deed copy

After receiving the No Objection from the public.

Can i file a petition in the court with all the documents like police certificate, paper advertisement, No objection from public, photo copy of sale deed.

So that court can give a clear chit in loss of original document and which can give a more confidence for any buyer and can be use a link document for further future transaction.

As per my experience any buyer will look for clean documents and all link documents in original for any future transaction for them. But In my case I have lost sale deed of my name

Plz advice.

It was not necessary to do all these things, you could have obtained the certified copy of the sale deed and could have filed a case.

You can get declaration from the court on the basis of said document.

Sale deed must registered so get a copy form the concerned office dully certified.

You can approach the Court for declaration.

It is not necessary to approach a court. Get a certified copy of the Deed of sale from the Registry office. This can be used as secondary evidence of its contents.

Make an injunction; and there place the certified copy before the Court where you are applying for injunction and then obtain the certified copy of the court; it will be having double certification - two aspects in this regard that the Sub-registrar will be cautioned by your this move and your property will be in the list of "wanted" by the SR and nobody can transfer it and if it is transferred than the concerned SR will be liable.
