(Querist) 20 August 2010 This query is : Resolved 
my father had let a shop of 10 sq. mtrs on rent and the tenant is there for last 30 years. he is paying just rs. 100 as rent , which is being deposited with the rent controller . now the thing is that he is not paying the electricity bill since past 6 months when it was temporarily disconnected for non-payment. the meter is in my fathers name. now we have reeived a final notice from the electricity department that the dues of rs.10,946/- have to be paid by 25/8/10 or else the money will be recovered through land revenue.
for tht we have met the advocate and sent a letter to him about the same with a xerox copy.
incase of non-payment will we be in a position to evict him or wht are the other chances to evict him.

he hardly comes to the shop as he deals with renting of sound system and it is closed, he is rich with wife working in bank, son on ship
could i have ur guidance dear sirs.

does the shop having separate ele.connection? how come frequently closed shop will consume ele.power worth Rs.10946 for 6 months.does ur family member want the shop for starting your own business you can plead in court, but it will be time consuming process.try another quasi-legal way. in case of non payment of ele. bill you cant evict. recovery by land revenue means the authorities will put the property in auction and fulfill the dues.

first of all i m very grateful for ur reply SIR,
the shop has a separate connection.
the bill of rs.10946/- was before disconnecting it temporarily the same bill has not been paid till date .
so now we have received the notice for permanent disconnection.
yes i do require the shop for myself.
cat i ask the shop for my sis.
at present i m working but not much salary just rs. 4000/-, and there is no one working in govt. service or big names.
cos i want to file for asking for my use the other shop bigger than this.
or can you suggest any other method to evict him may be by force. that we entering and removing his belongings and so on.
