bail bond

Querist : Anonymous (Querist) 26 October 2010 This query is : Resolved
Is bail bond(whatever amount may be in rupees)furnished before police/magistrate/court refundable???
Devajyoti Barman (Expert) 26 October 2010
No money is getting deposited and hence no question of refund. The amount to be paid by the surety only if the bond is forfeited.

It varies from state to state, in some state it is in cash mode and in some you have to keep papers of property and/or vehicles etc.etc. if you r acquitted or discharge from the case, bail bond shall be released and you will get the same. In case of bail bond furnished by the surety in that event it is difficult to get back the said bail bond amount.

If court has ordered to cash surety then it is to be deposited in the court. After the acquittal amount will be refunded. If not just you ( surety)have to produce the property extract before the court.

In West Bengal there is no provision for fpr depositing the cash.

Cr PC is applicable all over India. However courts do not prefer to accept cash security since accounts have to be maitained.

Regarding refund whether accused or surity , cash security given is refundable on aquital and if fined the fine amount will be deducted.

So avoid such problems best way is to give approved financial documents such bank FDR dully discharged., which will be returned on completion of trial.

I go with Shashi Kumar Sir.

Definitely crpc is not applicable to all over India in its uniform manner. For example several states like UP does not have the provision for anticipatory bail. Whatever advices given here is definitely not applicable in West Bengal.

I agree with Mr.Shashi.
