Yes rights of tenancy always lies with licencee.

A licencee cannot claim to be at par with a tenant and as such, does not have the rights of a tenant.

The laws dealing with licenses are totally different from the laws dealing with tenants. Licence can be revoked at anytime and no prior notice is required. But in case of tenancy notice of termination is mandatory. A licensee does not have all the legal protection as in the case of a tenant.Moreover license is not a transfer of property whereas lease is a transfer of property.
