Querist : Anonymous (Querist) 07 February 2011 This query is : Resolved
Sir,
I would like to know the following
1) What effect can 498a and DV case can have on Husbands bank balance and also on husband's Father or Brothers bank balances.

2) What effect can 498a and DV case can have on Husbands property and also on husband's Father or Brothers properties.

with regards

1. The cases under section 498A and DV Act are bound to reduce the bank balance of husband as he will have to incur money on defending them. It will depend on the facts of each case whether the bank balances of father and brother of the husband also meet the same fate.

2. Same as above.

expenses will be there to fight the case, so naturally bank balance comes down

There will be indirect impact on the properties. They have to spend for facing the case.

There shall not be any effect either on bank balance o properties held by husband or inlaws of such wife though cases have to be fought. Both the cases are like criminal cases so the proceeding is entirely different than civil suit.
