i had patched up with my husband in 2006 through delhi high court .my husband has started touturing me again along with my child who is eleven, how can i start legal process by sending a notice to his lawyer or get the court involved directly.he has promise to pay me an amount of Rs. 30000 which he has hiked to 35000 only in which i pay as 15000 towards education of my daughter.if i do not file for seperation or divorce wil court look into the matter that 35 k is very less and take the maintenance up.we are still co habiting

If he has promise to pay an amount to you it doesn't matter .
For getting maintenance you should go to court and prove your husband income and the court also see your husband income life style,etc and your income if any --after that the court will give you monthly maintenance and your daughter.
If you are living with your husband then you don't get any maintenance and my advise is to try to resolve your dispute with your family members or counselor.
If you file for judicial separation or divorce then you will also ask for maintenance.
But before that try to settle your problem amicably.Consult your family members in this matter otherwise go to court.
