Husband is an indian & Muslim citizen and his wife is canadian mislim citizen. Both married a year back in india through muslim rituals, and both went back to Canada as the visa of husband was sponsered by his in-laws. Quite some time inlaws along with wife started harrasing husband. husband came back to india. Now he want divorce. which law will be applicable as the wife is canadian citizen and shariah law does not prevail in Canada? And what is the liability of husband. It is pertinent to mention here that husband do not have any property in Canada.

Since the husband is still an Indian and resident of India , he can visit a Quazi and give her a triple talaq in presence of two witnesses and obtain a talaqnama.

As their marriage had taken place as per Muslim rituals so divorce can also be given as per Muslim law prevailing in India.

Twist in the tale.

According to Shariah, whenever there is a dispute between the customs of bride and groom. One Shia other Sunni, One Muslim other Kitabia, One from Jurisdiction A other from B. The law of the respondent is applicable for Talaaq.
