Divorce again

Guest (Querist) 11 November 2011 This query is : Resolved
My huaband applied for divorce 2 years back and i applied for RCR, 498A. And after the counselling he withdrew the divorce and i also withdrew RCR, 498A.
Now again himself and his parenst are creating problem... They are threatening they will again apply divorce as before. Is it possible?
How to proceed further?

what is the cause for divorce now? what problems are being created ?

if you are victim of domeestic violence

you can make application under Dv act for right to stay in shared household , maintenance etc .

If there are new cause of action, yes, he can file for divorce again.

Yes it is very much possible.
If he so files then you would get the chance to contest it or admit it.
So take decision as per your priority.

Yes he may apply for procuration of decree of divorce again .However if you want to continue with marriage you may contest as earlier .However since you have withdrawn your application u/s 498A ( probably with leave of court ) and form your commuincation it does not appears that there is no fresh demand of dowry thereafter then case under section 498A will not be of siginificant strength against them
